What the office assesses

A CEIDG or KRS entry proves registration, but it does not replace evidence of actual activity. The office reviews income, taxes, contracts, cash flow, jobs, investments and your actual role.

The law provides several ways to demonstrate the economic value of the business: meeting the income criterion, creating the required jobs, or showing a credible ability to meet those conditions in the future. The calculation depends on the year and voivodeship.

JDG and a company: what changes

For a JDG, the focus is on your own entrepreneurial activity: contracts, settlements, taxes and actual services or sales.

For a company, the office separately reviews your role, authority and the connection between management participation and the company’s activity. The document set therefore differs from a regular work-based case.

When the business is still new

A short operating history does not mean an automatic refusal, but it requires convincing evidence: a business plan, contracts, invoices, investments, demonstrated demand and a clear financial forecast.

Before filing, compare the business basis with other available routes. It may be safer to strengthen the evidence or use another legal basis.

Frequently asked questions

Is opening a JDG or sp. z o.o. enough?

No. Registration proves that the business exists, but the office reviews actual activity, performance, documents and your role.

Can I apply if the business is new and its income is low?

A new business or low income does not mean an automatic refusal. Convincing evidence of activity and a realistic plan for meeting the statutory criteria are needed.

Do I have to employ staff?

Not always. The law provides several ways to show the economic value of the business: income, jobs, or a credible ability to meet those conditions in the future.

What does the two-employee criterion mean?

It is one statutory route and generally concerns at least two full-time, indefinite employees employed for at least 12 months before filing. Eligible employee categories and evidence must be checked separately.

Do I need a business plan?

For a new business or where current figures do not yet meet the criteria, a business plan helps explain investments, demand, forecasts and the path to compliance.

What does the office usually review?

Income, taxes, accounting records, contracts, cash flow, jobs, investments and the applicant's actual role in the business.

Can I be both a shareholder and an employee?

Sometimes, but the residence basis depends on the shares, management role, contract and actual nature of the work. The documents must be assessed together.

Who completes the MOS attachment?

The electronic attachments depend on the business form and the applicant's role. If there is separate employment, an authorised company representative prepares the employer documents; the exact route is checked before filing.

What are the public fees?

The stamp duty for a business-based permit is PLN 340 and the residence card issuance fee is PLN 100. Payment details and current amounts should be checked again before payment.

What if there are ZUS or tax arrears?

Arrears can weaken evidence of genuine and stable activity. Before filing, review the accounts and prepare an explanation or proof that the issue has been resolved.

Can I travel while the case is pending?

A passport stamp or pending case confirms stay in Poland but does not by itself provide a right to re-enter after travel. This depends on a valid visa, card or another basis.

What should I do after a business-related wezwanie?

Check the deadline and requested items first. The office may ask for accounting records, contracts, payments, staff evidence or an explanation of your role, and the response must be filed on time.
